Terms & Conditions for SideB Marketplace

1. Introduction

Welcome to SideB, an online marketplace for buying and selling vinyl records in New Zealand. These Terms & Conditions govern your use of our website and services provided at sideb.co.nz (“Site”). By using our Site, you agree to comply with and be legally bound by these Terms.

2. Definitions

“SideB,” “we,” “us,” or “our” refers to SideB marketplace.
“User,” “you,” or “your” means anyone accessing or using the Site.
“Seller” refers to a user who lists records for sale.
“Buyer” refers to a user purchasing records listed by Sellers.

3. Account Registration

To sell or buy records, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password.

4. Listing and Selling

Sellers must:

Provide accurate descriptions and genuine images of listed records.
Clearly state pricing, shipping, and return policies.
Ensure records are authentic and as described.

5. Buying

Buyers agree to:

Review all product details before purchasing.
Complete payment promptly upon purchase confirmation.

6. Fees

SideB charges Sellers a commission fee of 1.5% per sale, plus a payment processing fee of 2.9% + 30 cents per transaction. Fees are deducted automatically from sale proceeds.

7. Payments

Payments are securely processed via third-party payment processors. SideB is not responsible for delays or issues arising from these payment processors.

8. Returns & Refunds

Sellers must clearly specify return policies. Buyers should contact Sellers directly regarding returns. SideB is not responsible for managing returns but may mediate disputes.

9. Disputes & Resolution

In case of disputes:

Attempt direct resolution between Buyer and Seller.
If unresolved, contact SideB customer support. SideB will mediate but does not guarantee resolution.

10. User Conduct

Users must not:

Engage in fraudulent activities.
Post inappropriate or unlawful content.
Use the Site for unauthorised commercial activities.

Violation of these rules may result in account termination.

11. Intellectual Property

Content on SideB, including logos, trademarks, and text, is owned by SideB or its licensors and protected by intellectual property laws. Users may not copy, reproduce, or distribute content without explicit permission.

12. Liability Limitation

SideB is not liable for:

Loss or damage from transactions between Buyers and Sellers.
Interruptions, delays, or inaccuracies on the Site.

Our total liability is limited to the fees paid to SideB related to your use of the service.

13. Changes to Terms

SideB may modify these Terms at any time. Changes will be communicated via email or prominently displayed on the Site. Continued use after changes indicates acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed according to the laws of New Zealand. Disputes will be subject to the exclusive jurisdiction of New Zealand courts.
